WORKERS' COMPENSATION

Under the Pennsylvania Workers’ Compensation Act, workers who are injured on the job have the ability and the right to be compensated for medical expenses as well as for income loss. Specifically, to seek a claim for Workers’ Compensation, your injury must have occurred while you were acting in the course and scope of your employment.


It is important to note that Workers’ Compensation benefits are typically paid by private insurance companies. Therefore, the dispute is generally with the insurance company and not with your employer.


An injured worker typically receives about two-thirds of the wages that they made prior to being injured. However, Workers’ Compensation benefits are non-taxable. If an injury is severe and considered to be permanent, then the injured worker may be entitled to special benefits.


A worker who suffers from a disease that they contracted while acting in the course and scope of employment may also qualify for Workers’ Compensation benefits. For example, a coal miner who suffers from Black Lung Disease may qualify for Workers’ Compensation benefits.

It is important to note that you must notify your employer of a work related injury within 120 days of the date of the injury.
